There are no trees in the scene at all, it's a waterfront setting.  As bellyboy indicated and I stated clearly, he gets shot the first time and staggers into a bunch of hanging ropes and stands there suspended in them  The sniper has a clear view of him all the time, he's not behind anything.  He's totally exposed.  The sniper gets frustrated because he just won't die like he's supposed to.
